Welcome to JSMac Webmasters (“Platform,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern the use of our website, services, and marketplace by Freelancers and Employers/Clients. By accessing or using the Platform, you agree to be bound by these Terms.
If you do not agree, please do not use the Platform.
1. Definitions
Platform β The website and services operated by JSMac Webmasters.
Freelancer β An individual or entity offering services through the Platform.
Employer / Client β An individual or entity hiring Freelancers through the Platform.
User β Any person who accesses or uses the Platform.
Services β Digital, technical, creative, or professional services offered by Freelancers.
2. Eligibility
You must be at least 18 years old and legally capable of entering into contracts to use the Platform. By using the Platform, you represent that all information you provide is accurate and truthful.
3. Account Registration
Users must create an account to access certain features.
You are responsible for maintaining the confidentiality of your login credentials.
You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Terms for Freelancers
4.1 Freelancer Responsibilities
Freelancers agree to:
Provide accurate information about skills, experience, and services.
Deliver services professionally, ethically, and on time.
Communicate clearly with Employers regarding scope, timelines, and expectations.
Comply with all applicable laws and regulations.
4.2 Service Delivery
Freelancers are solely responsible for the quality and legality of their services.
Any agreement made with an Employer is a binding contract between the Freelancer and Employer.
Revisions, timelines, and deliverables must be clearly agreed upon before work begins.
4.3 Independent Contractor Status
Freelancers are independent contractors, not employees, partners, or agents of JSMac Webmasters. We do not control how services are performed.
5. Terms for Employers / Clients
5.1 Employer Responsibilities
Employers agree to:
Provide clear and accurate project requirements.
Pay agreed fees on time.
Communicate promptly and respectfully with Freelancers.
Use delivered work only as agreed upon.
5.2 Payments
Payment terms must be agreed upon before work begins.
Employers are responsible for releasing payments once milestones or projects are completed.
Failure to pay may result in account suspension or legal action.
6. Fees and Payments
Platform service fees (if any) will be disclosed before a transaction.
All payments are handled through approved payment methods.
Refunds, if applicable, are subject to the agreed terms between Freelancer and Employer.
7. Intellectual Property
7.1 Freelancer Work
Unless otherwise agreed, ownership of work transfers to the Employer only after full payment.
Freelancers retain the right to display work in portfolios unless restricted by agreement.
7.2 Platform Content
All website content, branding, logos, and materials are owned by JSMac Webmasters and may not be used without permission.
8. Prohibited Activities
Users may not:
Misrepresent identity or qualifications.
Engage in fraudulent, illegal, or abusive activities.
Circumvent the Platformβs payment systems.
Upload malicious software or harmful content.
9. Dispute Resolution
Users are encouraged to resolve disputes amicably.
JSMac Webmasters may, but is not obligated to, assist in dispute mediation.
We are not liable for disputes arising from contracts between Freelancers and Employers.
10. Limitation of Liability
To the maximum extent permitted by law:
JSMac Webmasters is not liable for indirect, incidental, or consequential damages.
We do not guarantee the quality, legality, or outcome of services provided by Freelancers.
11. Termination
We may suspend or terminate access to the Platform at any time for violations of these Terms or applicable laws.
12. Privacy
Use of the Platform is also governed by our Privacy Policy, which explains how we collect and use personal data.
13. Modifications to Terms
We reserve the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
